Terms of Use

By accessing or using the Rupert Fund Finder platform ("Platform") operated by Rupert Invest (Pty) Ltd ("Rupert", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform. These Terms of Use must be read together with our Privacy Policy and Disclaimer, which are incorporated herein by reference.

Rupert Fund Finder is an informational and educational tool that: - Provides a searchable database of South African investment funds - Generates personalised fund match suggestions based on your stated preferences using an algorithm - Displays fund performance data sourced from publicly available information - Connects users with information about licensed financial advisors Rupert is NOT a Financial Services Provider (FSP) licensed under the Financial Advisory and Intermediary Services Act 37 of 2002 ("FAIS"). We do not provide personalised financial advice, portfolio management, or investment intermediary services. Nothing on this Platform constitutes a recommendation to buy or sell any financial product.

To access certain features of the Platform, you must create an account. By creating an account, you agree to: - Provide accurate, current, and complete information during registration - Maintain the security of your password and account - Notify us immediately of any unauthorised use of your account - Accept responsibility for all activities that occur under your account You must be at least 18 years of age to create an account. We verify this using the first 6 digits of your South African ID number (your date of birth). Providing false information constitutes a breach of these terms and may result in immediate account termination. We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used for fraudulent or unlawful purposes.

Rupert offers the following subscription tiers: - Free: Basic fund discovery and YTD/1-year returns at no cost - Basic (R99/month): Full returns history including 3-year and 5-year annualised returns - Pro (R199/month): All Basic features plus licensed advisor contact details and API access All paid subscriptions are processed by PayFast (Pty) Ltd, a licensed South African payment service provider. Subscription fees are charged monthly on your billing date. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until then. We do not offer refunds for partial billing periods. We reserve the right to change subscription pricing with 30 days' written notice to your registered email address.

Our fund matching algorithm generates suggestions based on your responses to our risk assessment questionnaire. These suggestions are algorithmic outputs only and do not constitute financial advice. Free users may retake the quiz up to 3 times. Additional retakes require a Basic or Pro subscription. The number of fund matches shown is limited by subscription tier: - Free: 3 matched funds - Basic: Up to 10 matched funds - Pro: Up to 20 matched funds and full API access We do not guarantee that any matched fund is suitable for your specific financial circumstances.

Users may save funds to a personal watchlist, subject to the following limits: - Free: 5 saved funds - Basic: 10 saved funds - Pro: 20 saved funds Watchlist data is stored locally on your device and is not backed up by Rupert.

Pro subscribers may access fund data programmatically via the Rupert REST API. By using the API, you agree to: - Use the API solely for lawful purposes and in accordance with these terms - Not redistribute, resell, or make the API data available to third parties without our written consent - Not use the API to build competing products or services - Not attempt to circumvent rate limits, authentication, or access controls - Keep your API key confidential and revoke it immediately if compromised We reserve the right to throttle, suspend, or revoke API access for any account that violates these terms or that places excessive load on our infrastructure.

You agree not to use the Platform to: - Violate any applicable law or regulation - Impersonate any person or entity or misrepresent your affiliation - Attempt to gain unauthorised access to any part of the Platform or its infrastructure - Introduce malware, viruses, or other harmful code - Scrape, crawl, or harvest data from the Platform without our written consent - Use the Platform for any commercial purpose without our prior written approval - Circumvent subscription limits or access controls through technical means Violation of these terms may result in immediate account suspension and, where applicable, legal action.

All content on the Platform, including but not limited to text, graphics, logos, fund matching algorithms, software, and data compilations, is the property of Rupert Invest (Pty) Ltd or its content suppliers and is protected by South African and international copyright laws. Fund performance data is sourced from publicly available information and is provided for informational purposes. Asset manager names, fund names, and related trademarks belong to their respective owners. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

The Platform may contain links to third-party websites, investment platforms, and financial service providers. These links are provided for convenience only. Rupert has no control over the content, accuracy, or availability of third-party sites and accepts no responsibility for them. When you click on a platform link (such as EasyEquities or Allan Gray), you will be redirected to that provider's website. Any account opening, investment, or transaction you conduct with a third party is governed by that party's terms and conditions.

By using the Platform, you consent to Rupert collecting anonymised usage data, including which funds you view, which platform links you click, and how you interact with the Platform. This data is used to improve our service and, in aggregated anonymous form, to demonstrate platform engagement to prospective commercial partners. We do not sell your personal data. Please refer to our Privacy Policy for full details on how we collect and process your information.

To the maximum extent permitted by South African law, Rupert Invest (Pty) Ltd shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from: - Your use of or inability to use the Platform - Any investment decision made based on information from the Platform - Errors, omissions, or inaccuracies in fund data - Interruption, suspension, or termination of the service - Unauthorised access to your account or data Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid to us in subscription fees in the 3 months preceding the claim.

You agree to indemnify and hold harmless Rupert Invest (Pty) Ltd, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms of Use, or your violation of any rights of a third party.

We may update these Terms of Use from time to time. We will notify you of material changes by email or by displaying a prominent notice on the Platform. The date at the top of this page reflects when the terms were last updated. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated terms. If you do not agree to the revised terms, you must stop using the Platform and may close your account.

You may close your account at any time by contacting us at support@rupertinvest.co.za. Upon termination, your right to use the Platform ceases immediately. We may suspend or terminate your account at any time if you breach these Terms of Use, if we are required to do so by law, or if we decide to discontinue the Platform. We will endeavour to provide reasonable notice where possible.

These Terms of Use are governed by the laws of the Republic of South Africa. Any disputes arising from or relating to these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the South African courts. Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@rupertinvest.co.za. We will endeavour to respond within 14 business days.
